In 2008, Marina Rivas was driving home from a business trip when she was hit by a tractor-trailer driven by a J.B. Hunt employee who ran a red light. Rivas' vehicle was pushed through the intersection and slammed into a pole. The driver of the tractor-trailer fled the scene, leaving the victim severely injured.

Rivas had to be extracted from the vehicle and was taken to the hospital by emergency crews. She sued H.B. Hunt Transport Services Inc. and Jeffrey Gaines for damages. The driver pled no contest to a criminal charge of hit and run.

In the four years leading up to the trial, both sides disputed liability. J.B. Hunt admitted liability at the outset of trial, and the matter proceeded for damages.

Injuries

Rivas was diagnosed with a concussion and moderate to severe brain injury. She continued to suffer from cognitive impairments, chronic pain, depression, and other conditions due to her injuries. She also has not been able to work since the accident, and had to move in with her cousin who helped with her care and financially.

Result

The jury ultimately rendered a verdict in favor of Rivas and awarded her over $20 million in damages. The award included over $7 million for her future medical expenses and $12 million for her past and future pain and suffering. The jury found punitive damages were not warranted.
