Plaintiff John Doe was a special needs high school student who was sexually assaulted several times by another student. Most of the assaults took place outside a bathroom on the school campus during lunchtime.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff claimed that the school district was negligent in its supervision of its special needs students. The assault took place at an area of campus that was off-limits to students during lunch. Campus security failed to adequately patrol the campus during the lunch hour.
DEFENDANT'S CONTENTIONS:
Defendant claimed its security was adequate and that it had not observed the two students in the off-limits area. Plaintiff willingly went to the bathroom with the other student and never complained about the incidents until the boys were caught in the bathroom one day.
Injuries
Plaintiff suffered severe emotional distress.
Result
The case settled for $3 million at mediation before Jeffrey Krivis.
