Facts
Michael Gradney was driving a 2004 Lincoln Town Car owned by Personal Sedan Services LLC. According to Araceli Gonzalez, Gradney caused an accident in which Gonzalez was injured. Gonzalez claimed she was crossing the street when she was struck by the limo. Her head went through the windshield and she lost consciousness.
Gonzalez sued Gradney and Personal Sedan Services for alleged negligence, negligence per se, negligent hiring, supervision, and/or retention, and respondeat superior.
Injuries
Gonzalez claimed she suffered a fracture of her thoracic spine, which required surgical repair. She also suffered an anterior pelvic ring fracture, right side rami fractures, and a right anterior acetabular fracture. She lost three teeth and suffered a tibial plateau fracture, nasal fractures, subarachnoid hemorrhage, lip laceration and liver laceration.
Result
The jury awarded Gonzalez $1,861,140 in damages. However, the jury also determined that Gonzalez was 25 percent at fault, reducing the total award to $1,395,855.
