Facts
On May 27, 2010, Joshua Abdallah was arrested for public intoxication and placed in Sacramento County's Main Jail. While in jail, Abdallah banged on cell windows and the cell door, and complained about his situation. Deputies decided to move him into a safety cell. In the safety cell, the officers placed Abdallah face down on the floor, handcuffed him as he twisted on the floor, and then beat him until he was unconscious. He filed an administrative damages claim against the county.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff claimed that the force used by officers against him was excessive, and that he did not fight back.
DEFENDANTS' CONTENTIONS:
Defendant claimed that plaintiff resisted offers, thrashed on the ground, and refused the officers' orders while in the safety cell. As a result, defendants argued that the level of force used was appropriate.
Injuries
Plaintiff suffered blunt head trauma, liver laceration, hematoma, blunt trauma to the chest, blunt abdomen injury, nasal fracture, and facial lacerations.
Result
The county agreed to pay $75,000 in settlement.
