Plaintiffs, 1,278 line-haul drivers for FedEx Freight West Inc. brought a putative class action against FedEx Freight West ("FedEx West") alleging violations of California law, including California wage and hour laws.
FedEx sought to decertify the class and filed a motion for summary judgment in an attempt to dispose of the action. Both motions were denied.
Settlement Discussions
The parties engaged in mediation sessions in 2008, and again in February 2011, which were unsuccessful. The parties thereafter recommenced their settlement negotiations, and ultimately reached a settlement following a third mediation session in June 2011. The Court approved the terms of this settlement in January 2012.
Result
Total settlement was for $5,250,000. Of this sum, the court awarded $1,750,000 in attorney fees and $104,997 in costs to Plaintiffs' counsel.
