A class of patrons of Fleming's Prime Steakhouse & Wine Bar in California between June 7, 2012, and Feb. 23, 2011 filed a class action against OSI Restaurant Partners LLC.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiffs alleged that Defendant used a credit card form in its restaurant and bars that had a pre-printed space for customers to fill in their telephone numbers, which plaintiffs alleged violated Civil Code Section 1747.08(a)(3).
Result
The parties reached a settlement under which Defendant will provide each class member with a one-time $50 voucher to be used at Fleming's restaurants.
