Facts
David Bergstein was an independent film financier and business entrepreneur. He filed a breach of fiduciary duty and professional malpractice lawsuit against his former in-house attorney, Susan Tregub. Plaintiffs argued that Tregub "switched sides" and worked with Aramid Entertainment Fund, an adversary of Bergstein's. Plaintiffs argued that Tregub helped Aramid launch five involuntary bankruptcy proceedings and three federal lawsuits against Bergstein and his companies.
Result
The jury found that Tregub breached her fiduciary duty and committed professional malpractice. The jury awarded more than $50 million, including $500,000 in punitive damages, to Bergstein and two of the plaintiff companies. The Court found for Tregub on Plaintiffs' equitable claim for specific performance – return of documents.
