Settlement Discussions

Defendant driver's insurance carrier settled for policy limits of $100,000. Plaintiff had a 250/500 under-insured motorist policy. After protracted communications, plaintiff's carrier paid remaining UIM policy limits of $150,000.

Injuries

Plaintiff suffered excruciating left upper extremity pain and weakness. Following an MRI, she underwent an anterior cervical diskectomy and fusion at C5-6 and C6-7. The post-operative diagnosis was of herniated disc C5-6 and C6-7 with associated osteophyte complex and spinal cord and nerve root compression with triceps weaknesses.

Result

The case settled for $250,000.
