On Nov. 16, 2009, at approximately 7 p.m., plaintiff Jane Zhang Ma, 41, a pedestrian, sued Defendant, alleging negligence, when she was struck by the rear portion of Defendant's vehicle while walking across the street.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended that Defendant was distracted because he was talking on his cell phone at the time of the event.
DEFENDANT'S CONTENTIONS:
Defendant denied talking on his cell phone. Defendant contended that Plaintiff exaggerated her injuries because she did not fall to the ground during the alleged collision. Defendant further contended that Plaintiff was at fault because she was walking outside the boundary markings of the crosswalk at the time of the accident.
Injuries
Plaintiff claimed to have suffered bruising to her arm and back injuries.
Result
Defendant was found to be 75 percent negligent and Plaintiff was awarded $27,073, with a final reduction to $25,000 because the case was filed in a limited jurisdiction court.
