Christopher Anderson was staying at a condominium in Mission Viejo. The condominium was owned by Scott Chaban, and had been rented by Anderson's friend, Joe Sanders. He sued both Chaban and Sanders.
Contentions
PLAINTIFF'S CONTENTIONS:
Anderson claimed that while he was using the condominium's stove to boil hot water, he tried to use the drawer under the stove to get to another cooking pot. When he did so, the stove tipped towards him, spilling the boiling water onto Anderson. Anderson was badly burned, and argued that either Chaban or Sanders had put in the stove improperly, causing the accident that had injured him. He based his argument on the fact that a tip guard had not been installed on the stove, despite a sticker on the stove directing that a tip guard was needed. He also claimed that Chaban had known about the problems with the stove, but did not do anything to fix them.
Damages
Anderson requested $95,000 for his medical costs.
Injuries
Anderson's legs and left foot were badly burned, requiring surgery and a skin graft.
Result
The parties decided to settle their dispute through a mediator for $237,500. Chaban paid $212,500, while Sanders paid the remaining $25,000.
