Jose Lopez sued Bassam Mourtada based on an accident that occurred while he was riding his bicycle.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that on Oct. 19, 2011, he was riding his bicycle in North Hollywood. Plaintiff claimed that while Mourtada was driving his car out of a parking lot, Mourtada failed to properly pay attention to his surroundings and hit him. The collision threw Lopez to the ground, injuring him.
DEFENDANT'S CONTENTIONS:
Mourtada argued that his car never made contact with plaintiff or his bike.
Damages
According to defendant, plaintiff's medical specials were $13,463.64 and future care estimated at approximately $25,000.
Injuries
Plaintiff complained of injuries to neck, low back, left knee, left shoulder, left arm, left hand and claimed that he needed epidural injections to the back as a result of the accident.
Result
A jury concluded that Mourtada was 51 percent liable for the accident, and found that Lopez was 49 percent liable. The jury found that Lopez's damages were worth $15,000. Based on the comparative liability offset, the award was lowered to $7,650.
