Orrin Bellinger sued Sergio Sanchez based on a car accident. Bellinger also sued Riverside County, Sanchez's employer.
Contentions
PLAINTIFF'S CONTENTIONS:
Bellinger claimed that on Oct. 12, 2010, Bellinger was driving in Riverside with his wife, Denise Bellinger, and granddaughter, Annica Galindo. Their vehicle was stopped at a red light when they were rear ended by Sanchez. At the time, Sanchez was allegedly on duty with the Riverside Sheriff Department.
The Bellingers and Galindo's guardian, Kristal Collins, argued that Sanchez had not been paying attention while he was driving, and that Riverside was responsible for Sanchez's actions.
DEFENDANT'S CONTENTIONS:
Sanchez claimed that the accident was not his fault.
Damages
Orrin Bellinger sought $10,000 for past medical costs and $120,000 for future medical costs. Denise Bellinger sought $99,000 for past medical costs and $120,000 for future medical costs. They also sought $5,000 for the damage to their vehicle.
Injuries
The Bellingers both injured their necks and backs. They both also claimed that the accident exacerbated their pre-existing conditions. Collins claimed that the accident injured Galindo's back.
Result
The parties decided to settle their claims out of court for $90,000. Orrin Bellinger received $65,000, while Denise Bellinger received $25,000.
