Facts

Defendant, an agency that provides landscape contractors with group insurance programs in the California and Nevada areas, was sued by plaintiffs, husband and wife, for marital status and gender discrimination.

Kenneth Cole alleged marital status discrimination after being terminated when his wife, plaintiff Amy Cole, went to work for a direct competitor company.

Amy Cole claimed gender discrimination based on childcare issues after she was denied a promotion to a managerial position within the company.
