Plaintiff Lorena Alamo was a lead collector at defendant Practice Management Information Corporation. She was terminated on the day she returned from maternity leave.

Contentions

DEFENDANTS' CONTENTIONS:
Defendants claimed that plaintiff was terminated for performance reasons discovered for the first time while she was out on maternity leave; although, there was no intention to fire her before she went out on leave. Defendants also claimed that plaintiff was terminated for coming in and having lunch with a co-worker while she was on leave and having a verbal argument with that co-worker.

Settlement Discussions

Defendant offered $20,000 at mediation, followed by $25,000 right before trial. Plaintiff demanded $150,000.

Damages

Plaintiff claimed emotional distress damages. Plaintiff contended that her past wage loss was approximately $39,644 and that she had approximately $10,604 in benefit losses.

Total of $71,472, notwithstanding interest was awarded ($50,858 in attorney and paralegal fees; notwithstanding the win of $10,000; and $10,614 costs).
