On July 28, 2010, Daniel Bernal was operating a truck southbound on Freeway 57 when he came to a stop for heavy traffic and was rear-ended by a motorist driving a sport utility vehicle, while in the scope of his employment with Enterprise-Rent-A-Car.
Bernal filed suit against Enterprise.
Contentions
PLAINTIFF'S CONTENTIONS:
Bernal filed suit against Enterprise, alleging motor vehicle negligence. Bernal contended that the car's driver was going too fast given the traffic and not paying attention to the roadway.
DEFENDANT'S CONTENTIONS:
Enterprise denied that a significant collision occurred, alleging that the vehicle struck Bernal's hitch but never made contact with the bumper.
Injuries
Bernal alleged that he suffered soft-tissue injuries to his back, undergoing epidural injections, and chiropractic treatment.
Result
The parties reached a settlement for $37,000.
