Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff suffered from disability that rendered her unable to work. Among other things, plaintiff suffered from left shoulder impingement syndrome, obesity, anxiety, and depression. Plaintiff alleged that the administrative law judge's decision to uphold the Commissioner's denial of her application was erroneous because the ALJ failed to assess the impact of literacy on the identified jobs.
DEFENDANT'S CONTENTIONS:
The ALJ determined that plaintiff was not disabled.
Result
The court agreed with Madueno's assertion and granted her motion for summary judgment. As such, it remanded the matter to the Commissioner for further consideration.
