John Moore sued Gibson Brands Inc., Gibson Guitar Corp., and Stanton Group d/b/a Stanton Magnetics Inc., pursuant to Prop. 65.

Contentions

PLAINTIFF'S CONTENTIONS:
Defendants allegedly sold, manufactured, or otherwise made available headphones with vinyl/PVC components, including Stanton DJ Pro 50 S headphones, that exposed consumers to DEHP, a known harmful chemical, without providing the requisite Prop. 65 warnings.

DEFENDANTS' CONTENTIONS:
Defendants contended it maintained compliance with all laws at all times.

Result

Gibson Brands, Gibson Pro Audio Inc. (together, Gibson) and Moore reached a consent judgment providing both monetary and injunctive relief. As part of the settlement, Gibson agreed to make available only reformulated products and provide the requisite warnings. Gibson also agreed to pay $6,000 in civil penalties.
