Plaintiff Terry Gene Bollea, also known as professional wrestler Hulk Hogan, sued defendant Gawker Media LLC after it posted a sex tape video of him on its website.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended that he was unaware he was being filmed and that the public posting of the tape constituted an invasion of privacy. He also asserted misappropriation of the right of publicity.
DEFENDANT'S CONTENTIONS:
Defendant contended that the posting of the video was protected under the First Amendment because it was a matter of "legitimate public concern."
Result
The jury awarded plaintiff $140 million in damages, which included $55 million in economic damages, $60 million in noneconomic damages, and $25.1 million in punitive damages.
