Morgan Hunt sued Christopher Hoffman and California Commercial Works in connection with a motor vehicle collision that allegedly occurred in June 2012.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff, who was driving a step van, contended he was stopped for a red light on El Capitan Ave., when he was broadsided by a pickup truck operated by defendant Hoffman. Hoffman was entering the intersection with West Shaw Ave., when the light turned green. The force of impact caused plaintiff's vehicle to be pushed onto another pickup truck, totaling all three cars. Plaintiff sued defendant and his employer, defendant California Commercial Works, alleging negligence and vicarious liability. The matter proceeded against Hoffman only after it was determined that he was merely doing business as California Commercial Works.
DEFENDANTS' CONTENTIONS:
Defendant disputed plaintiff's claimed damages. Defendant contended that plaintiff's claimed emotional distress was not caused by the subject accident, but rather frustration over his workers' compensation and employer. Defendant also denied plaintiff suffered a traumatic brain injury.
Settlement Discussions
Hunt made a CCP 998 demand for Hoffman's policy limits of $750,000. Hoffman offered $200,000 in settlement.
Damages
Hunt missed several months of work and was placed on total temporary disability.
Injuries
Hunt allegedly suffered a mild traumatic brain injury as a result of the impact. He also sustained various injuries to other parts of his body, including his head, back, chest, and pelvis. Despite treatment, he continued to experience ongoing pain and discomfort. At one point, he had to undergo surgery to remove and repair a hernia that was related to his injuries from the crash. He was also diagnosed with post-traumatic stress disorder and other cognitive issues.
Result
The jury ultimately rendered a verdict in favor of Hunt and awarded him $1,492,297 in total damages, including $50,933 for past medical expenses, $67,120 for future medical expenses, $123,761 for past lost earnings, $770,000 for future lost earnings, and $480,000 for past non-economic damages.
