Facts
LinkedIn user, Katie Szpyrka filed a class action against LinkedIn on behalf of premium, paid users of LinkedIn, alleging negligence over a security breach. Hackers obtained personal information from members, including email addresses, passwords, and login credentials. The hackers infiltrated more than 6 million passwords from LinkedIn users online. The lead plaintiff paid $26.95 per month for a premium membership.
Result
U.S. District Judge Edward Davila dismissed the complaint for lack of standing because the complaint did not "sufficiently demonstrate that the Plaintiffs' bargain for premium membership was the promise of a particular (or greater) level of security that was not part of the free membership."
