Facts
This case arises out of an auto v. auto accident that occurred on March 9, 2000. The claimant was traveling
northbound on Serrano Road in the City of Lake Forest. The claimant was waiting for traffic to clear so that
she could turn left on to Lake Forest Drive. The uninsured motorist was traveling eastbound on Lake Forest.
This intersection was controlled by a three-phase traffic signal. The claimant entered the intersection on a green
light. The uninsured motorist illegally entered the intersection against a red light and collided with the left side
of the claimantÆs vehicle causing the accident.
The force of the impact caused approximately $2,865 in property damage to the
claimantÆs vehicle. The property damage claim has been resolved. As a direct result of this
accident, the claimant suffered various injuries which could have been more severe but for the
fact that she was wearing her seat belt at the time.
Settlement Discussions
The claimant demanded the policy limit of $15,000. Allstate offered $10,810.
