PLAINTIFF'S CONTENTIONS:
Plaintiff dba RooR USA designed and manufactured smoker's products. Plaintiff alleged that its award-winning products were widely recognized because of its intricate designs. Plaintiff accused defendants of selling counterfeit RooR products. As such, plaintiff sued, asserting claims for trademark infringement, trademark counterfeiting, false designation of origin/unfair competition, unfair competition (California Business & Professions Code), and common law unfair competition.
DEFENDANTS' CONTENTIONS:
Defendant Farag denied the allegations and asserted various affirmative defenses.
Result
Farag subsequently entered into joint stipulation with Sream for permanent injunction enjoining it from further infringement.
