Facts
Rosa Rivera sued Gareth Slaven and the owner of the vehicle he was driving, Heather Miles, following a collision between Rivera's GMC Envoy and Miles' Volkswagen Eos. The collision occurred at the intersection of Ocean View Ave. and Charnock Road in Los Angeles on August 17, 2011.
Contentions
PLAINTIFF'S CONTENTIONS:
Rivera contended that Slaven negligently operated the vehicle and that Miles was vicariously liable. She claimed that there was no stop sign on Chamrock where it intersected with Ocean View Drive, and therefore, Slavin should have yielded the right of way.
DEFENDANTS' CONTENTIONS:
Slavin conceded that he did not see Rivera's vehicle and did not contest liability. Miles denied liability and asserted various affirmative defenses.
Damages
Rivera sought $50,000 for medical costs and pain and suffering.
Injuries
Rivera was taken to the emergency room by ambulance and was treated for injuries to her back, a sprained ankle, and contusions to her sternum. She then underwent treatment by an orthopedic surgeon for the sprained ankle and a chiropractor for her back injury.
Result
The parties settled for $25,000.
