American General Life Insurance Co. filed a complaint for interpleader and declaratory relief against Julie Harper, Lina Harper and Homer Harper, as legal guardians of minors J.C.H., J.C.H., and J.C.H., in connection with the life insurance policy of the decedent, Jason Harper.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that in 2004, Julie Harper, as owner, and Jason Harper, as insured, applied for life insurance coverage. The application designated Julie, the decedent's wife, as the primary beneficiary and their son, J.C.H., as contingent beneficiary. Plaintiff issued a life insurance policy with a face amount of $500,000. Following the decedent's death on Aug. 7, 2012, plaintiff received multiple and conflicting claims from Julie and from Lina and Homer Harper, on behalf of Julie and the decedent's three minor children.

Result

The parties agreed to enter into a stipulation for entry of an order of discharge in interpleader and dismissal with prejudice in favor of plaintiff. As such, American General was discharged from any liability to the defendants with respect to the life insurance policy. In turn, the defendants were restrained from instituting or prosecuting any action against American General with respect to the life insurance policy.
