Facts

On Feb. 12, 2008, Maria Garcia was driving on Route 60, and stopped due to traffic. A tractor-trailer driven by Arthur McKay in the course and scope of his employment with P.A.M. Transport crashed into the rear of car that was behind Garcia's vehicle. The car slammed into Garcia's vehicle as a result. Rodriguez filed an action against McKay and P.A.M., alleging motor vehicle negligence and vicarious liability.

Settlement Discussions

Plaintiff demanded $7,500,000 and defendants offered $700,000.

Plaintiff suffered anxiety, brain damage, compression fracture, concentration deficits, depression, fracture of transverse processes, headaches, insomnia, jaw injury, memory loss, post-traumatic stress disorder, tinnitus, and unconsciousness.
