Facts

Third Pillar Inc. entered into a contract agreeing to provide software for De Lage Landen Operational Services LLC ("DLL") to aid in its financial leasing business.

Contentions

PLAINTIFF'S CONTENTIONS:
DLL filed suit against Third Pillar, alleging breach of contract, violation of the California Uniform Trade Secrets Act, and unjust enrichment. DLL contended that it divulged proprietary information regarding its business through detailed use cases, and Third Pillar breached their contract by sharing that information with other customers as well as incorporating the information into other software.

DEFENDANT'S CONTENTIONS:
Third Pillar denied the allegations, contending it owned the use cases information as well as the resulting software.

Damages

DLL sought injunctive relief preventing Third Pillar from using or disclosing its information, proprietary materials and work product, as well as the return of the materials.

Result

The court rendered a verdict enjoining Third Pillar from possessing, disclosing or re-using DLL's 12 use cases, which were deemed to be combination trade secrets, with other customers, in written or software form.
