Facts
On June 13, 2008, Mei Lu was driving her 2005 Honda Accord on the freeway as her husband, Amado Gaivan, sat in the passenger seat. As Lu was driving, the car experienced directional control issues and the car ended up going off of the freeway. The vehicle then rolled over. Lu, Gaivan, and Lu's parents filed a lawsuit against American Honda Motor Co., Honda North America Inc., and Valley Hi Toyota, which were the manufacturers and the seller of the car, respectively.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiffs argued that defendants should be held liable for negligence, breach of warranty, products liability, loss of consortium, and negligent infliction of emotional distress.
Damages
The claimed medical expenses totaled $1,222,344.
Injuries
Lu suffered polytrauma, cardiac arrest, vertebrae fractures, bilateral hemopneumothoraces, periaortic hematoma, and anoxis brain injury with persistent vegetative state.
Result
The parties reached a settlement amounting to $2,500,000, under which plaintiff Lu received $2,000,000, Gaivan received $300,000, and Lu's parents each receved $100,000.
