Facts

Plaintiff Lauren Gresham filed a class action suit against defendant Celico Partnership dba Verizon Wireless alleging that she was charged for unsolicited premium text messages sent by Kepler & Associates LLC dba JokeMobi.com. The class consisted of Verizon Wireless members who were billed/charged premium for messages sent by Keplar & Associates LLC.

Defendant Verizon Wireless indicated improper charges amounted to about $955,000.

Result

Parties settled for $1,194,750, which included a $1,000 incentive payment to Gresham, $238,750 in attorneys' fees and refund payments worth $955,000. Plaintiff class members will be given a credit on their bill or in cash. Settlement was preliminary approved on May 23, 2008.
