Facts

On July 20, 2006, the plaintiffs alleged that defendant William O. Robards ran a stop sign in Coto de Caza Drive and Vista del Verde in Coto de Caza, striking plaintiff Suzanne Haggerty on the driver's side of her vehicle, causing her vehicle to spin around 180 degrees. Plaintiff suffered a disabling rotator cuff injury.

The defendant alleged he entered the intersection first and that plaintiff was at fault.

Damages

Suzanne Haggerty, a 47-year-old homemaker, did not claim for loss of earnings. Both plaintiffs made a claim for loss of the value of household services.

Injuries

Plaintiff Suzanne Haggerty had a rotator cuff tear with a permanently partially "frozen shoulder" despite three shoulder surgeries by two different orthopedic surgeons, as well as two manipulations of the shoulder under general anesthesia. She also underwent nearly constant physical therapy for the past two years since the accident. The defendant claimed that Suzanne Haggerty's injuries were pre-existing due to a prior accident three years earlier.

Result

The case settled for $550,000.
