Facts

Plaintiff Kathleen Immediato's father, Ralph Immediato, was admitted into the U.S. Department of Veterans Affairs, Center for Rehabilitation and Extended Care (CREC) on June 30, 2004 for a 30-day respite residency. Ralph Immediato had Parkinson's disease and suffered from post-traumatic stress disorder and possible dementia. He also had previously been diagnosed with prostate cancer. Ralph Immediato contracted a urinary tract infection, fell ill and passed away on July 29, 2004 of sepsis.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended that prostate cancer was especially vulnerable to urinary tract infections. She alleged that the medical staff failed to property treat her father's urinary infection and that defendant would not place her father in acute care. She filed suit against the United States alleging professional negligence, willful misconduct, wrongful death, elder abuse, fraud and constructive fraud.
