Facts
James Wood filed a class action lawsuit against defendant Coach, Inc. alleging violations of the California Civil Code section 1747.08 pursuant to the Song-Beverly Credit Card Act. The class was composed of individuals who bought items with a credit or debit card from any California Coach retail store between May 23, 2006 and July 28, 2008, in which defendant stored the customer's personal address, telephone number or e-mail address. The class is approximately 640,000 members large.
Contentions
PLAINTIFFS' CONTENTIONS:
Plaintiffs contended that defendant unlawfully exercised a policy to retain credit card customers' personal addresses, telephone numbers or e-mail addresses.
DEFENDANT'S CONTENTIONS:
Defendant denied plaintiffs' allegations.
Result
Each plaintiff member will receive a 30 percent discount. Members can also exchange the discount for $25 credit. Jared Wood, the class representative will be given a $6,000 incentive payment. Attorney's fees were awarded in the amount of $225,000.
