Facts

On July 27, 2005, Carlos Alonso's van rear-ended the vehicle of Jason Kim and his wife, Grace Kim, while they were stopped at a red light. The Kims brought an action against Alonso and Karcher Insulation-Karcher Environmental Inc, the van's owner, for motor vehicle negligence.

Contentions

PLAINTIFFS' CONTENTIONS:
The Kims alleged that Alonso drove too fast, was inattentive, and that the collision's impact was severe in light of damages to the defendant's vehicle.

DEFENDANT'S CONTENTIONS:
The defense used photographs to show that the accident did not cause any significant damage to the Kims' vehicle. Further, Alonso stated that the damage to his vehicle was pre-existing.

Damages

Both Jason Kim and Grace Kim requested $43,000 for past and future medical expenses plus an unspecified sum for general damages.

Injuries

The plaintiffs claimed injuries to the back and neck, radiculitis, and herniated disc at L4-5, which required physical therapy and chiropractic treatment.

Result

The jury found in favor of the defense.
