Plaintiff Kevin Gunter filed on behalf of himself and a proposed class, which included California escrow officers working for defendant Fidelity National Financial Inc. (FNF) between June 3, 2004 and Aug. 27, 2007.
Gunter filed suit in Los Angeles County Superior Court and Fidelity National removed the case to the U.S. District Court for the Central District of California on June 29, 2007.
Contentions
PLAINTIFFS' CONTENTIONS:
Gunter et al. contended that they were misclassified as exempt employees and FNF failed to properly compensate them for overtime work and rest breaks.
DEFENDANT'S CONTENTIONS:
Fidelity National Financial contended that plaintiffs were properly classified and properly remunerated.
Result
Gunter et al. settled the suit for $1,650,000, which was divided into $500,000 for attorney fees, $7,500 to Gunter as incentive payment, $21,000 for claims administrator expenses, and $10,000 to the California Labor and Workforce Development Agency. Final approval for the settlement was granted on Jan. 30, 2008.
