Three Rivers Levee Improvement Authority brought an eminent domain action against Satinder Davit to take 99 acres of Davit's land to construct a flood control levee. The plaintiff appraised the property at $1.8 million. Davit appraised the take at $3.4 million.

The statutory final offer before trial was $2,250,000 and defendant's final statutory demand was $2,750,000.
