Facts
On Sept. 29, 2006, plaintiffs' decedent Sean Jamison, a 27-year-old real estate investor and developer, was riding as a passenger in a car driven by defendant's decedent, Sean's brother, Bryan Jamison. Bryan and Sean's father, John Jamison, was also in the car. All three men died when the vehicle collided with a flat-bed truck. Sean's estate, by and through his wife, Crystal Jamison, sued Bryan's estate for motor vehicle negligence.
Contentions
PLAINTIFFS' CONTENTIONS:
Plaintiff contended Bryan fell asleep while driving, drifted into oncoming traffic, and hit the flat-bed truck head-on. Bryan was therefore the sole cause of the accident.
Damages
Crystal sought damages for loss of care, comfort, and society.
Injuries
Sean lost his life and his wife suffered loss of society.
Result
The parties settled for $1.5 million (policy limits) prior to trial.
