Facts

Plaintiff Cell-Crete, as a subcontractor, entered into a written contract with defendant Forecast Builders, the general contractor, to install specialty concrete at the real property known as Americana Homes located at 227 South Brand Avenue in Glendale. Cell-Crete performed its work. Americana Homes was the owner of the project.

Thereafter, a dispute arose between Americana and Forecast. The dispute did not involve Cell-Crete's work. However, Cell-Crete was not paid $564,303 as a result of the dispute between Americana and Forecast.

Cell-Crete filed suit for breach of contract against Forecast and to foreclose a mechanic's lien against Americana. Americana agreed to pay Cell-Crete $525,785 to resolve the claim against it. Cell-Crete accepted that sum. Cell-Crete continued its lawsuit against Forecast for the remainder and interest, fees and costs.

Result

The case settled for $525,785.
