Facts

Joseph Northington sued Daniel Zerom, in connection with a motor vehicle incident that allegedly occurred on Aug. 28, 2013.

Contentions

PLAINTIFF'S CONTENTIONS:
Defendant allegedly made a U-turn in front of plaintiff, who was on his bike. Defendant allegedly did not signal his intentions in making the turn, and so plaintiff was struck without warning.

DEFENDANT'S CONTENTIONS:
Plaintiff allegedly came out of nowhere. Defendant claimed it was plaintiff's fault. Defendant also moved to quash plaintiff's attempted substituted service of summons for lack of jurisdiction.

Damages

Northington sought $16,694 in compensatory damages, which included $136 for the estimated repairs of his bike and $11,964 in medical expenses.

Injuries

Northington fractured his cheek and wrist. He also sustained a head injury. Moreover, he underwent intervals of depressions as a result of the incident.

Result

The trial court ultimately granted Zerom's motion to quash service of summons.
