Martha Izaguirre sued the International Coffee & Tea LLC, The Coffee Bean & Tea Leaf, and Marina Boyd, in connection with her employment at Coffee Bean.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff claimed that she began working for Coffee Bean in January 1998. In April 2010, she was involved in an accident, and fractured several bones in her wrist that needed surgery. As a result, she requested time off from work, and provided her doctors' notes regarding the dates she would be off work. On July 13, 2010, Coffee Bean fired her. As a result, plaintiff sued defendants alleging violations of the Fair Employment and Housing Act and the California Family Rights Act. Plaintiff contended that defendants failed to provide reasonable accommodation, failed to engage in the interactive process, discriminated against her because of her disability or perceived disability, and retaliation.
DEFENDANT'S CONTENTIONS:
Defendants denied plaintiffs allegations, and asserted various affirmative defenses.
Result
The jury rendered a verdict in favor of Izaguirre and awarded her $125,000 in total damages, including $40,000 for past economic damages, $80,000 for past non-economic damages, and $5,000 for future non-economic damages.
