Facts

Plaintiff Nancy Dunlap was a paying customer and patron inside defendant LT Nail Salon. She was seated and getting her nails done when suddenly, a 30-pound mirror fell off the wall directly on top of plaintiff's head with substantial impact. The mirror shattered. The mirror was lodged on top of plaintiff's head and back until removed. The defendant had incontrovertible liability. The mirror that fell on plaintiff was held on the wall by one nail.

Injuries

Plaintiff sustained injuries to neck, shoulders, arms and hands. Plaintiff's experts diagnosed cerebral concussion syndrome, neurosensory hearing loss, and left tinnitus. Defense experts disputed that plaintiff had sustained head or brain injury or post-concussional disorder and argued that plaintiff's neck and shoulders resolved generally. They also found that plaintiff had a history of rhinitis and reflux laryngitis, and these two conditions have contributed to her Eustachian tube dysfunction. Defense expert diagnosed depression, mixed migraine and tension-type headaches.

Result

Plaintiff's verdict for $150,000.
