On Sept. 1, 2006, at 11:30 a.m., plaintiff William Gibbs was driving a 2001 Honda Accord at 50 mph southbound on the 605 freeway. Defendant Ronald Martin struck the rear end of plaintiff's vehicle pushing plaintiff's vehicle into the SUV in front of him. The plaintiff jolted inside his vehicle upon both impacts. The defendant fled the scene before the police arrived. The plaintiff claimed that the defendant is liable for the accident.
