On Jan. 18, 2000, the plaintiff, a 42-year-old homemaker was walking in San Francisco and was about to cross at the intersection of 39th Street and Ortega. The defendant, driving a Toyota, was on his way to San Francisco State University and was attempting to make a left turn at the intersection of 39th and Ortega. He claimed that he waited for several pedestrians to cross the street, and while making his turn, he was blinded by the sun. The plaintiff claimed that she was struck on her left side by the defendant's vehicle.
