The defendant turned left from a private driveway, and in so doing collided with the plaintiff who was traveling
on a through street at approximately 35 mph and was unable to avoid frontal impact. The parties agreed to
binding arbitration with a minimum of $10,000 and a maximum of $130,000.
The plaintiff contended that the mild traumatic brain injuries she suffered were as a direct result of the
accident, although this was not diagnosed for over one year.
The defendant contended that the plaintiffÆs problems were due to depression and were
unrelated to the accident. The defendant disputed that the plaintiff suffered from mild traumatic
brain injuries.
Settlement Discussions
The plaintiff submitted a C.C.P. Section 998 demand of $130,000. The defendantÆs offer was $15,000.
