Facts

On March 22, 1995, plaintiff Sabino Hidalgo Jr., a 20-year-old manual laborer for defendant. The plaintiff's right arm was amputated at the elbow when it was caught while he was cleaning a screw conveyor. The plaintiff brought this action against the defendant based on negligence.

Settlement Discussions

The plaintiff made a settlement demand for $6 million, which was reduced to $4,995,000 on Nov. 9, 1998. The defendant made an offer of $198,650 on Oct. 26, 1998. The workers compensation lien of $107,000 was settled for $67,500.

Injuries

The plaintiff's right arm was amputated.
