Facts

On June 9, 1998, Susan Bumstead-Smith claimed that she was injured in a collision that occurred at the
intersection of 5th and Colorado in LaJunta. The plaintiff alleged that the defendant, Velma Michels, ran a stop
sign and struck her SUV broadside.

Settlement Discussions

The plaintiff demanded $25,000 (policy limits) to Velma Michels. Velma Michels offered $20,000 before trial.

Injuries

Bilateral carpal tunnel syndrome and chronic neck and back pain requiring on-going chiropractic treatment. The PIP carrier paid more than $34,000 in medical expenses. The plaintiff was not allowed to make a claim of certain economic losses related to future medical expenses because it was not timely disclosed.
