Prudencio Torres, 48, was a production line worker with The Vendo Co., which manufactured and supplied soft drink machines. After 17 years of employment, Torres was terminated in 2001.

Settlement Discussions

Torres demanded $670,000. Vendo offered $60,000. The jury awarded $60,000 in compensatory damages. Prior to the punitive damages phase of the trial, the parties settled for $255,000.

Damages

Torres claimed damages for loss of earnings and emotional distress. Vendo's expert testified that Torres should have been reinstated within 90 days after his termination.

Other Information

Prior to trial, the court granted Vendo's motions for summary judgment as to Torres' retaliation and wrongful termination claims. Torres voluntarily dismissed his sex discrimination claim during trial. This left only the national origin termination claims for the jury to decide.
