Facts

The case concerned the ownership rights to "Agent Cody Banks," a project that ultimately resulted in a film and sequel starring Frankie Muniz. Also at issue was the right to produce a DVD compilation of "The Mary Tyler Moore Show" along with value-added material.

Settlement Discussions

Gold offered to dissolve the partnership and split, three-ways, the remaining $28,000 in partnership assets. David and Burnett rejected the offer and demanded, instead, that they receive the entire $28,000; and that Gold pay them an additional $25,000 and give each of them two credits on future film or television projects.

Result

The arbitrator, retired Judge Lester E. Olson, ordered a net award of $707,214 to Gold, which included $71,000 in attorney fees and $19,872 in costs.

Other Information

David and Burnett filed a motion for reconsideration, which the arbitrator denied.
