Claimant Guadalupe Garcia and her son George were sitting in her car in a shopping center parking lot, waiting for her daughter. At the same time, a man was being chased by police. The man forced his way into the plaintiff's car and threatened to kill her if she did not drive. She began to drive, but was stopped by the police, who shot the man at point blank range, while he was still inside her vehicle. The claimant filed an uninsured motorist claim with respondent Mercury Insurance Company. The respondent denied her claim.
