Facts
On March 17, 2006, plaintiff Tracey Christoffel, age 42, received chiropractic treatment and manipulation from defendant Ronald Vaselenko, D.C. The plaintiff alleged that she suffered immediate pain and tingling at the time of the treatment and the next day when she returned for treatment at defendant's facility.
On March 23, 2007, the plaintiff presented to her family practitioner for continuing neck pain. She was given an MRI that day, which showed a herniation to the C4-5 level of her cervical spine. Thereafter, the plaintiff was referred to orthopedic surgeon, Dr. Jeffrey Deckey, who performed an operation on plaintiff to correct the herniation.
Contentions
PLAINTIFF'S CONTENTIONS:
The plaintiff contended that Vaselenko breached the standard of care during a chiropractic manipulation of plaintiff's neck.
DEFENDANTS' CONTENTIONS:
The defendants denied all liability, causation, and disputed the damages. The defendants alleged that the herniation was degenerative in nature and that plaintiff had long suffered from neck pain going back to a 1987 automobile accident, among other things. The defendants claimed that the chiropractic manipulation could not have and did not result in enough force to cause the herniation.
Result
Verdict for $132,785.
