Facts

On Jan. 17, 2006, plaintiff Ezekiel Toledo was stopped at a red light at the intersection of Shoreling Boulevard and Montecito in the city of Mountain View. Defendant Flores was driving a vehicle registered to Christian and Rosa Flores, when he failed to notice that plaintiff was stopped. The defendant collided with plaintiff's vehicle. The defendant admitted liability, however, contested the severity of plaintiff's damages.

Damages

The plaintiff's vehicle was totaled.

Injuries

The plaintiff was taken via ambulance to El Camino Hospital in Mountain View where he was treated for neck pain and released the same day. The plaintiff underwent conservative medical treatment, including physical therapy and prescription drug treatment. However, despite these treatments, the plaintiff still had complaints of neck and lower back pain three years post-accident.

Result

The jury awarded plaintiff $17,598 ($11,598 economic; $6,000 non-economic).
