Michael Ruiz was rear-ended by a vehicle operated by Joseph Vicens. The impact pushed Ruiz into the car ahead of him. Ruiz sued Vicens for negligent operation of a vehicle. Vicens admitted liability.

Damages

Ruiz claimed $200,000 in past medical costs and an additional $115,000 in lost earnings. He claimed that a back surgery may be necessary and that he will not be able to work as an executive chef for another year due to the residual pain and discomfort.

Injuries

Ruiz claimed injuries to his neck and back. Ruiz drove himself to the emergency room following the accident. He received epidural injections to his lower back and underwent an anterior cervical discectomy with plating one year after the accident. He continued to suffer from residual pain and discomfort in his neck and back.

Result

The parties negotiated a settlement. Ruiz received $493,200 as part of the settlement.
